Either parent can petition for a change in support........ but only if they have a reason to petition. Courts aren't fond of people taking their exes back to court over and over again and they can do things like make you pay your exes lawyer fees, or make an order that will force you to attend counseling prior to be able to ever file again. At least, that's the threat they make in California.





Obviously, if you are the one paying the support and there's been a change in your income... like you lost your job... then you'll want to go to court and make a change in support if you can't afford your old amount. Likewise, if the child is spending more time with you, or your ex, then there can be a change in the support and either of you can file for a change.
